State issues permits, not county
To clarify last week’s story concerning the shutdown of Tylertown Daquiri Shop, the license permit is issued by the state Dept. of Revenue, rather than county supervisors.
The county has limited regulatory control, most often how close such establishments can be to certain areas. The requirements vary depending on county regulations.
Regulations regarding how close a beer and light wine seller or liquor-licensed establishment can be to schools, churches, residential areas, and other similar establishments. These distance restrictions help ensure that sales do not negatively impact surrounding communities.
Walthall County has a 600 ft. distance requirement of such an establishment from churches, schools, funeral homes and similar type businesses.
As the state approved the license, the county, through an oversight, and because of state approval, did not realize the business was not compliant with the distance requirement.
Tax and ABC agents shut down the business because of violation of Dept. of Revenue and ABC regulations.
Supervisors revoked the operation based on the 600 ft. local requirement.
